3. Description of Services
Timber Sculpt MDF Inc. provides computer systems design, enterprise integration, cloud infrastructure, cybersecurity, technical consulting, and digital transformation services (the Services). The Site serves as a platform for informational purposes, communication, and engagement with potential and existing clients. Any agreement for the provision of Services will be governed by a separate service agreement executed between Timber Sculpt and the client.
4. Use of the Site
4.1 License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for lawful, personal, and informational purposes. You may not reproduce, distribute, modify, or create derivative works of any content from the Site without our prior written consent.

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THEREIN ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Site at your own risk.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIMBER SCULPT MDF INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE.
Our total liability to you for any claims arising out of or relating to these Terms or the Site shall not exceed the amount you have paid us, if any, in the twelve months preceding the event giving rise to the liability.
9. Indemnification
You agree to indemnify, defend, and hold harmless Timber Sculpt MDF Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party right.
10. Termination
We reserve the right to suspend or terminate your access to the Site at any time, without prior notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 7, 8, 9, and 13.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Site shall be resolved exclusively in the courts located in Chilliwack, British Columbia, Canada.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by Timber Sculpt on the Site, constitute the entire agreement between you and Timber Sculpt MDF Inc. concerning your use of the Site, superseding any prior agreements or understandings, whether written or oral.
